1. General Provisions
1a. These conditions govern the remote purchase of products via the internet on the site minari-engine.com, hereinafter also referred to as the Site, owned by Parmakit s.r.l. Strada Antolini, 18/C – 43044 Lemignano di Collecchio, Parma, VAT number 02011740343, registered in the Parma Business Register REA PR203849.
2. Acceptance of General Terms of Sale and Conclusion of Contract
2a. Sending an order, whether through the minari-engine.com website or via email, constitutes the conclusion of the sales contract between the Site and the Customer. It also serves as a declaration that the Customer has reviewed all information provided during the purchase process and accepts these terms of sale in their entirety.
3. Prices
3a. All product prices shown on minari-engine.com are in Euros, excluding VAT, and already include any discounts.
3b. Shipping costs are not included in the purchase price.
3c. Prices may be changed at any time without prior notice.
3d. In the event of a computer, manual, technical, or any other type of error that results in a substantial change to the sale price not intended by the Site—making it either exorbitant or negligible—any purchase order completed by the Customer will be considered invalid and cancelled, and the amount paid will be refunded.
4. Product Availability
4a. Products on the Site are understood to be available at the time the Customer places the order. However, such availability should be considered purely indicative.
4b. If a Customer wishes to purchase a quantity of a product higher than what is shown as available on the site, we recommend contacting us via email to proceed with the request.
4c. The photo in the product sheet is for illustrative purposes only, as dimensions, colors, and related accessories may vary.
5. Purchase Methods
5a. Customers can place orders through the website or via email.
5b. Following the purchase, the Customer will receive an automated email confirming receipt of the order. The order will be processed as quickly as possible, followed by a confirmation and shipping email, including a tracking number provided by the courier to monitor the status of the delivery.
5c. If the Customer wishes to modify their order (e.g., add more items) or the data provided (e.g., shipping address), they must communicate this as quickly as possible and strictly before shipping through any available means of communication, ensuring they receive confirmation of receipt from minari-engine.com.
5d. The Site reserves the right to cancel in whole or in part, or to defer a received order for reasons of force majeure related to material supply, without previous order acceptance communications constituting confirmation or obligation, excluding any type of compensation for damages against minari-engine.com.
5e. The Site cannot be held responsible for delays in order processing.
5f. An invoice can only be requested at the time the order is finalized; it will be filled out using the data provided by the Customer during the purchase process and cannot be modified after issuance. The minimum amount for issuing an invoice to VAT registered entities is €40.00 + VAT.
6. Payment Methods
6a. Payment can be made using the listed methods. Any other type of payment must be agreed upon in advance.
Credit cards: Major credit cards are accepted. Payment is processed immediately upon sending the order.
PayPal: You must have an account, following registration on the PayPal site, to which you link your credit card or bank account. Payment is processed immediately upon sending the order.
Bank transfer: Payment must be made at the time the order is sent or no later than 24 hours thereafter, by making a bank transfer to the IBAN of minari-engine.com which will be provided when the order is sent, including the order number in the payment reference. Receipt of payment is not immediate, as it may take several days for the transfer to be completed. Consequently, this type of payment will require a longer processing time. The Site undertakes to process the order as soon as possible once the bank transfer is visible.
7. Delivery Methods
7a. Delivery of orders placed on the Site is carried out by couriers selected based on the destination indicated by the Customer at the time of the order.
7b. It will be possible to track the package’s progress using the tracking number provided by the courier and communicated via email by minari-engine.com or directly by the courier along with the shipping confirmation.
7c. Insured shipping can be requested, the cost of which varies based on the value of the goods. Customers are asked to make this request before placing the order.
7d. Goods are always shipped accompanied by a receipt/invoice.
7e. minari-engine.com cannot be held responsible for delays or non-delivery of goods.
7f. Goods are shipped carriage paid and the risk remains with minari-engine.com until the Customer or a third party delegated by them, other than the carrier, acquires physical possession of the goods. Upon delivery, the Customer is required to check the integrity and number of packages. If they are not intact or appear tampered with, the Customer must immediately report this to the courier, accepting them “with reserve.” In this case, the Customer undertakes to draw up, before collection and in the presence of the carrier, an acceptance document with reserve for any irregularities found. Once the packages have been collected, the Customer is required to verify the qualitative and quantitative correspondence of the goods compared to what was ordered. In case of discrepancies, the Customer is asked to report it in writing within seven days to minari-engine.com.
7g. Shipments that are not collected or that return to the sender without prior authorization from the Site will still be charged to the Customer.
7h. The Customer waives the right to raise any type of exception without having promptly and correctly fulfilled each of their obligations.
8. Shipping Costs
8a. Shipping costs are borne by the Customer and clearly highlighted at the time the order is finalized.
8b. Customers intending to place orders for delivery outside of Italy are asked to contact minari-engine.com in advance to request the amount of said shipping costs.
9. Order Cancellation
9a. The Customer can cancel their order before it is shipped by promptly sending an email to info@parmakit.com with the subject line “Order Cancellation No.” stating the intent to cancel and the order number.
9b. Cancellation is considered effective following an affirmative response confirming receipt of the previous email from minari-engine.com.
9c. If the conditions for the cancellation procedure are met, the Customer will be immediately refunded the amount paid with the order.
9d. If the communication of the intent to cancel the order reaches the Site after shipping has occurred, the Customer may exercise the right of withdrawal once the goods have been received.
9e. If the Customer requests order cancellation after shipping, they will be charged for the initial shipping costs, a flat fee of €20.00 covering order management following breach of contract, plus the shipping costs to return the goods to minari-engine.com, which will be borne by the Customer.
10. Right of Withdrawal
10a. According to current regulations, the Customer has the right to withdraw from the purchase without penalty and without having to specify the reason within 14 days from the date of receipt of the products ordered on minari-engine.com.
10b. This right applies to final consumers who are natural persons making purchases for purposes unrelated to their commercial activity or who do not provide a VAT number at the time of the order. It does not apply to professional consumers purchasing for purposes related to their professional activity or with a VAT number.
10c. The right of withdrawal applies to unused products in their original packaging and can concern the entire order or part of it. Goods ordered at the Customer’s request and exhausts are not subject to the right of withdrawal. For any doubts, we recommend asking for more information before purchasing.
10d. To exercise the right of withdrawal, it is necessary to submit a written request by sending an email to info@parmakit.com with the subject line “Withdrawal Order No.”, indicating the order number, and ship the goods to be returned in their original packaging, including every element, provided with the receipt/invoice and a copy of the email sent or a sheet transcribing the same indicating the intent to withdraw, taking particular care to pack the products accurately to avoid any damage. Return shipments missing any of these elements will not be eligible for the exercise of the right of withdrawal. Shipping costs for returning goods following withdrawal are borne by the Customer. Cash on delivery shipments or shipments with costs borne by the Site will not be accepted. The shipment must be made by the Customer within 14 days from the date the email exercising the right of withdrawal was sent.
10e. Following the return of the products and once the necessary checks have been carried out, if the conditions to proceed are met, the Customer will receive a refund of the price paid for the purchase of the goods, excluding shipping costs, through the same payment method used or another agreed method, as quickly as possible and in any case no later than 14 days from receipt of the goods at the minari-engine.com headquarters.
10f. If the returned goods are not accompanied by the required documents (receipt/invoice and copy of the email), are not complete in every part, element, manual, label, or packaging, or appear used or manipulated, it will not be possible to proceed with the normal and complete withdrawal procedure and the relative refund. In particular, the Customer is responsible for the decrease in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning, according to Directive 2011/83/EU para. 47 which states that “the consumer should only handle and inspect them in the same way as they would be allowed to do in a shop.”
11. Assistance Service for Info and Complaints
11a. The Customer can receive assistance and answers to their questions at any stage of the purchase process—before, during, and after—by sending an email to info@parmakit.com.
11b. In case of complaints that do not involve order cancellation or the exercise of the right of withdrawal, the Customer can write to info@parmakit.com.
12. Limitation of Liability
12a. Parmakit s.r.l. is committed to ensuring the best possible updates to the site and the accuracy of the information contained therein. However, it does not exclude the possibility of publication errors and inaccuracies in texts, prices, and images. The Customer agrees to fully waive the liability of Parmakit s.r.l. regarding these types of errors that may cause reliance on any incorrect information contained on the site.
12b. Parmakit s.r.l. reserves the right to modify the site and its contents in any part at any time without the obligation of prior or subsequent communication.
12c. Parmakit s.r.l. declines all responsibility in relation to direct, indirect, or consequential damages or losses, including delays, lost profits, or loss of other economic advantage, connected to or deriving from the use of the site or the information present on it, excluding the possibility for the Customer to pursue any type of compensatory action related to such reasons.
12d. Parmakit s.r.l. is not responsible for any type of direct or indirect damage deriving from the sale of the goods offered, as well as for the delay or non-delivery of the same or for the correspondence of the goods with the description on the site.
12e. Parmakit s.r.l. is not responsible for direct or indirect damage, accidents, injuries, or deaths occurring during the use of the goods sold through the site.
12f. Parmakit s.r.l. is not responsible for the use of goods sold on the site that does not comply with what is indicated in the manufacturer’s manual.
12g. Parmakit s.r.l. is not responsible for compatibility errors between the sold item and the Customer’s vehicle model if the error derives from the manufacturer’s catalog or website, from which information for the descriptions of products sold on the Site is taken.
12h. Some goods for sale on the Site are not intended for use on public roads, but only for sporting events on tracks or circuits and industry fairs. Parmakit s.r.l. distances itself from any type of use of these goods by the Customer that does not comply with regulations. Goods intended for road use are indicated as homologated.
13. Legal and Conventional Warranties and Warranty Limitations
13a. All products for sale on the Site are covered by a legal warranty for conformity defects on new products for a duration of 24 months and by the manufacturer’s conventional warranty. To benefit from the warranty, the Customer must keep the invoice/receipt received with the product. Requests will not be accepted if the Customer does not possess the invoice/receipt for the purchase of the item.
13b. If the Customer finds a conformity defect on a new product just purchased on the Site, they must immediately communicate it by sending an email to info@parmakit.com with the subject line “Warranty Order No.”, indicating the order number, attaching the receipt/invoice and any photos showing the product defect. The Customer will receive an email communication regarding the start of the preliminary assessment phase and, if the requirements for product replacement are met, will be invited to ship the product, complete in all its parts, accessories, and manuals, in its original packaging, together with the receipt/invoice, at their own expense to the minari-engine.com headquarters to proceed with the assessment of the defect, carried out through a technical check by minari-engine.com or the Manufacturer or an Authorized Service Center. Once the product has been received and examined, and the actual manufacturing defect has been confirmed, it will be repaired or replaced free of charge as quickly as possible and shipped back to the Customer, with shipping costs borne by minari-engine.com. If, following an assessment by Parmakit s.r.l. or the Manufacturer, a conformity defect is not found, the Customer will be charged for any verification, restoration, or transport costs incurred by Parmakit s.r.l.
13c. Legal warranty for the Consumer Customer: A Natural Person who purchases goods for sale on the Site for purposes not related to their professional activity or makes the purchase without indicating their VAT number during the order phase has the right to benefit from the legal warranty provided in case of manufacturing defects of the purchased item, by making a request within 24 months from the date of purchase shown on the invoice/receipt. This warranty applies to conformity defects, provided the item is used correctly, in compliance with its intended use and the instructions in the technical manual, has been installed correctly, and there have been no service interventions, maintenance, or repairs carried out by technicians not authorized by the Site.
13d. Legal warranty for the Professional Customer: A Professional Customer who makes a purchase for their business activity by entering a VAT number at the time of purchase has the right to benefit from the legal warranty for conformity defects on new products within 12 months of purchase.
13e. Manufacturer’s conventional warranty: To learn about additional specific warranties provided by the individual Manufacturer of the item purchased on Parmakit s.r.l., it is necessary to consult the Manufacturer’s website directly or the Manufacturer’s documentation accompanying the item.
13f. Warranty Limitations: The warranty for manufacturing defects applies only to new products that have been used/installed correctly, in compliance with their intended use and according to the methods provided in the Manufacturer’s technical documentation. The warranty does not apply if the defect is a consequence of negligence, incorrect use or installation not complying with the indications in the Manufacturer’s technical documentation, mistreatment, or deterioration deriving from misuse or storage, as well as from atmospheric agents, insufficient or irregular power supply, or product modifications. Product installation must be carried out by specialized professional personnel in the sector. Any technical intervention carried out without the authorization of Parmakit s.r.l. automatically voids the right to restoration/replacement of the item under warranty. All products perishable with use for which it is not possible to establish with certainty the cause of the malfunction because it is linked to external factors are not covered by the warranty. Batteries fall under this warranty limitation. To prevent batteries from undergoing an irreversible process of deterioration not covered by warranty, it is strictly necessary that they be maintained with a charge higher than 12V after being installed on the vehicle if it is not used for a prolonged period. In these cases, only the Manufacturer’s warranty applies.
13g. Goods that, after being examined, are not eligible for warranty coverage will be sent back to the Customer at their expense, including shipping costs for the return and any additional transport costs incurred by minari-engine.com for verification and restoration.
13h. If it is not possible to restore or replace a product covered by warranty for any reason, Parmakit s.r.l. may, at its discretion, refund the full amount paid by the Customer or replace the item with another with equal or superior characteristics. ⁃
13i. The terms for requesting warranty assistance are mandatory.
13l. Parmakit s.r.l. is not responsible for any type of damage deriving from delays in carrying out repairs or replacements of goods under warranty.
14. Applicable Law and Jurisdiction
14a. The online sales contract is understood to be concluded in Italy and is governed by Italian Law.
14b. For the resolution of civil disputes deriving from the conclusion of the distance selling contract, the territorially competent court is that of the judge of the place of residence or domicile of the consumer, if located in Italian territory.
